YOU ACKNOWLEDGE AND AGREE THAT THE LIMITATIONS SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THIS AGREEMENT AND THE SITE WOULD NOT BE PROVIDED TO YOU ABSENT SUCH LIMITATIONS. SOME STATUTES MIGHT APPLY REGARDING LIMITATION OF LIABILITY.

Disputes

Oikos’ Insights! is owned and operated by Soar Dime Ltd. a Canadian company, with offices in Clarenville, Newfoundland and Labrador (NL). This agreement shall be construed in accordance with the laws and statutes of the Province of Newfoundland and Labrador, Canada. Any legal action arising out of this agreement shall be enforced and litigated under the laws of Canada and shall be within the exclusive jurisdiction of the courts of Clarenville, NL.

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be deemed superseded by a valid enforceable provision that most closely matches the intent of the original provision and the remaining provisions shall be enforced.

Any controversy or claim arising out of or relating to this Agreement shall be settled by a binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The decision of the arbitrator shall be final and unappealable. The arbitration shall be conducted in Newfoundland and Labrador Canada and judgment on the arbitration award may be entered into any court having jurisdiction thereof.
